How does the whole process work?
I have spent over the past two decades constantly revising and streamlining the process to make filing bankruptcy as fast and painless as possible.
Our time proven process works like this:
1. Call me.
At your choice, I will speak with you on the telephone or in my office in White Plains. (I am real discreet on the phone).
We find that in person consultations work best.
Whether we speak on the phone or in person I will ask you a brief set of standard questions to make sure that bankruptcy is the right decision for you AND which Chapter is best for you.
If I recommend that you file for bankruptcy I will give you a fee quote in writing and send you two copies of a simple agreement and all of the notes from our consultation.
2. You return one copy of the agreement signed with a deposit (at
least $100) towards the total legal fees and costs. We accept cash, personal checks, money orders,
etc. You can also pay on line at any time by clicking
the Pay Now button on any page on this website.
3. We will send you a simple package containing:
- Document checklist;
- Credit report order form;
- Easy questionnaire;
- Pre filing counseling course information (you can take the course on the phone or on the internet: it only takes 90 minutes);
- Bankruptcy notice stickers to send to creditors if you want.
4. We will call you and set up a payment that
works for you. You send us the balance of the fees and costs. Again, we accept cash, check, money order,
etc. You can also pay on line at any time by clicking
the Pay Now button on any page on this website.
5. You return to us the completed package including ALL the information we need:
- Completed Document checklist and ALL documents required;
- Signed Credit report order form;
- Completed questionnaire (as best you can).
PLEASE do not send us the information to us in dribs and drabs. We will not start entering your information into Best Case™, the premier bankruptcy preparation program and filing system, until we have ALL of the information needed.
However, if you receive any law suits or notice that your wages are about to be garnished or your bank account has been frozen send it to us immediately.
6. Your case will be prepared and then reviewed by Amy, our senior paralegal and then reviewed by me within 2 days.
7. Your case will be mailed or emailed (at your choice) to you to review, sign (and to make any changes if needed) and returned.
8. Your case will be filed within 4 days (or if revisions are needed: revised, re sent to you to re sign and return to be filed.
9. In about 4 to 8 weeks after your case is filed with the Court you will meet with a Court appointed lawyer called a trustee.
10. I will be at the meeting with you. (In the unlikely event that I am unable to attend an experienced bankruptcy attorney fully familiar with your case will attend with you and send me a written report of the meeting).
11. You may be asked by the trustee to provide additional documents.
12. You should receive your discharge and your case will be closed in about 2 months after the meeting with the trustee. If you need to provide additional documents, your case will stay open until you comply.
